The Step-By-Step Framework explained

Step 1

Identify who is involved.

Step 1 is to identify all of the parties who might be of interest to your claim, or might have some baring on your claim. This can be some of your more obvious players like:

  • Parties that are at fault
  • The police

And then of course there are your less obvious ones such as:

  • Fire brigade
  • Ambulance services
  • The CTP insurer

And finally, there are the more obscure players to consider, such as:

  • Road traffic engineers
  • Civil engineers
  • Mechanical engineers

All of these have varying impact on your claim viability and need to be identified as soon as possible. For every day that passes, contact with some of these people can become harder and harder to contact and track down.

On this call we'll make sure you've considered everyone that could have a baring on your claim, as well as how to identify and get in contact with them. 

Step 2

Determine what the facts are.

The second thing we need to consider is the facts or circumstances around the accident. We'll want to consider some of the more obvious things such as:

  • The date of the accident
  • The time of the accident
  • The weather conditions
  • What speeds were involved

And some of the more obscure things:

  • Was the driver disqualified
  • Was the driver under any driving restrictions
  • Were there drugs or alcohol involved 
  • Who were the witnesses to the accident
  • What were the road conditions
  • Were there any dash cams that captured the accident

All of these circumstances are taken into consideration when calculating the likelihood of who was at fault and why. 

Step 3

Confirm the objective.

Now that we have the key contacts and details, Step 3 is about confirming what you want us to do with that information. More specifically, what you want to achieve on this phone call.

For most people, that will be understanding whether or not they have a viable claim, and what the likelihood of recovering something by way of compensation is. 

Step 4

List the obstacles.

Step 4 is then to identify the obstacles that could prevent you from having a viable claim. In compensation claims, there's generally two main obstacles that need to be overcome. They're:

  • Liability issues (proving you weren't at-fault); and
  • Quantum considerations (how much you're expected to receive in compensation, and how you can increase that). 

From a liability perspective, you need to be able to establish somebody was at-fault - and that can be partly at-fault or wholly at-fault.

From a quantum perspective, it's about building the evidence that you need to be successful in receiving a level of compensation.  

Step 5

Select the obstacle that needs to be dealt with first. 

In Step 5, we'll identify the most pressing liability and quantum obstacles that need to be dealt with first. 

For example, from a liability perspective, it could be that the Queensland Police have deemed you at-fault for the incident, whereas there might be witnesses on the contrary who support your version of events. 

From a quantum perspective, a common issue that we come across is someone who is self-employed, or perhaps they've been receiving an income through some sort of complex corporate or family trust structure. 

Step 7

Evaluate the effectiveness of the actions.

In the final step, Step 7, you'll be given the opportunity to go away, implement these things, and come back to us in 7 days to evaluate the effectiveness. 

If in these 7 days you've run into any roadblocks, we'll tell you how to get around these.
